CALL TO ORDER AND ROLL CALL The meeting was called to order by Mayor Jim Humpage at 6:04 P.M. A roll call was taken by Village Clerk Carlisle. Present were: Mayor Jim Humpage, Vice Mayor Tom Paterno, Council Member Geraldine A. Genco, and Council Member Pat Watkins. Also in attendance were: Village Manager Michael R. Couzzo, Jr., Village Clerk Gwen Carlisle, Assistant Village Manager Robert Garlo, Human Resources Manager Merlene Reid, and Police Chief William McCollom. II. APPROVAL OF AGENDA MOTION: Councilmember Genco moved to approve the agenda, as submitted; seconded by Councilmember Watkins. Motion passed 4-0. III. ANNOUNCEMENT BY MAYOR Mayor Humpage made the following announcement: Pursuant to Chapter 286.011 Section (8) of the Florida Statutes, the Village Council is commencing an Executive Closed Door Session for the purpose of discussing collective bargaining agreements regarding Communication Workers of America (CWA) and the Police Benevolent Association (PBA) contracts that September 30, 2006. The estimated length of the session is approximately 90 minutes. Those persons attending the session are: Mayor Jim Humpage, Vice Mayor Tom Paterno, Council Member Geraldine A. Genco, and Council Member Pat Watkins, Village Manager Michael R. Couzzo, Jr., Assistant Village Manager Robert Gazlo, and Human Resources Manager Merlene Reid. Council Member Genco asked if they were allowed to talk about the PBA if they did not vote for this to be discussed in an Executive Session at the last Council Meeting,. Mayor Humpage stated he did not know if it was an issue or not but they would begin negotiations Monday so they had to discuss it. Council Member Genco stated she did not know if she was properly notified on the Police Benevolent Association being apart of the Closed Door Session. Village Clerk Carlisle explained the PBA was not mentioned at the last Council meeting but Village Clerk Carlisle explained if they tabled discussions for the CWA to be discussed in an Executive session, Council could add anything that was related to that. Council Member Genco asked if it was noticed in the newspaper. Village Clerk Cazlisle stated no it was not but it was noted at the Town Hall where it is required to notice it and on the Village of Tequesta website. Council Member Genco stated she did not know discussions about the Police Benevolent Association would be apart of the Closed Door Session. She expressed doubt that legally they were allowed to discuss the PBA without it being announced at the Council meeting. Village Manager Couzzo stated it was his understanding that in litigation they were required to do that but Collective Bargaining Minutes -Village Council Budget Workshop Meeting 08/15/06 Page 2 was different. Council Member Genco expressed she hoped it was on the record that she did not know. Village Manager Couzzo offered to call the Labor Attorney. Council Member Genco stated subject to the Attorney's approval they could continue discussions on the Police Benevolent Association. The labor attorney stated due to the sunshine law it was alright to discuss the PBA. Attendees retired to the Executive Session at 6:00 P.M. IV. RECONVENE COUNCIL MEETING Mayor Humpage reconvened the meeting at 8:00 P.M. V. ADJOURNMENT MOTION: Council Member Genco moved to approve the agenda, as submitted; seconded by Council Member Watkins.
